(“Kemisync,” “we,” “us,” or “our”), a Delaware corporation, provides a professional networking platform for performers, agents, and casting professionals. This Privacy Policy describes our practices regarding the collection, use, and disclosure of your information through our website, mobile applications, and services (the “Platform”).


1. INFORMATION WE COLLECT

A. Information Provided by You or Your Authorized Representative

  • Account/Profile Data: Legal name, professional/stage name, contact information, date of birth, and professional attributes (e.g., union status, physical characteristics, credits).
  • User Content: Headshots, audio clips, resumes, and Self-Tapes/Reels ("Media Content").
  • Verification Data: For Young Performers (under 13), we collect verifiable parental consent. If using Government ID + Facial Match, this process is handled by a third-party vendor. Kemisync does not receive or store biometric identifiers or "facial geometry" hashes; we receive only a "pass/fail" verification token.

B. Automated Collection & Technical Data

  • Device/Usage: IP address, device identifiers, and platform interactions.
  • Cookies: Managed via our Cookie Consent Manager. We honor Global Privacy Control (GPC) signals and Universal Opt-Out Mechanisms.

2. HOW WE USE AND RETAIN YOUR INFORMATION

A. Processing Purposes

We process data to facilitate professional connections, verify eligibility, and ensure platform safety.

B. Retention & The "Professional Record" Paradox

  • Personal Profiles: Retained for the duration of your active subscription.
  • Submission Records: If you submit Media Content (e.g., a self-tape) to a specific casting call or share it with an Agent, that content becomes part of that professional’s business record. Even if you delete your profile, Media Content previously submitted to a third-party user may be retained by that user within their "Archive" for professional auditing purposes.

3. SPECIAL PROTECTIONS FOR PERFORMERS

A. AI & Digital Replicas

Kemisync is committed to the protection of performer likeness.

  • No Training: We do not disclose User Content to third parties for the purpose of training generative AI/ML models without express, written consent.
  • No Digital Replicas: We do not use your voice, image, or likeness to create "Digital Replicas" or synthetic performances.

B. Workplace Safety & Misconduct

To maintain a safe professional environment, Kemisync reserves the right to retain specific data—notwithstanding a deletion request—if such data is required for an investigation into harassment, fraud, or workplace safety violations, or to comply with industry-standard "Safety/No-Hire" reporting.


4. SHARING OF INFORMATION

We do not sell your personal information. Sharing is limited to:

  • Industry Professionals: Profiles are visible to vetted agents and casting directors based on your privacy settings.
  • Service Providers: Including cloud hosting (AWS), Content Delivery Networks (CDNs), and payment processors (Stripe).
  • Legal Obligations: To comply with subpoenas or protect the safety of our users.

5. MINORS AND YOUNG PERFORMERS

A. COPPA Compliance (Under 13)

We require Verifiable Parental Consent (VPC) via FTC-approved methods (e.g., Knowledge-Based Authentication or Credit Card Verification).

  • Privacy by Default: Minor profiles are hidden from public search and restricted from targeted advertising.
  • The "Eraser Law": In accordance with California law, minors (or their guardians) have a "Nuclear Deletion" right to request the removal of all content posted to the platform.
